The reason why its taking so long is well...my own stupidity....I paid this guy upfront $1100 cash and he told me it should be done in like 3-4 days. So I leave my car with him...three weeks go by...I couldn't take it anymore and told him I needed my car back. So i got it back and get this NOTHING is DONE... :x: I asked him why and he told me he's been busy with work and stuff....I was like watever....so day after day I've been pushing him to do a little by little and its still not done....I got my items like the subs and amp back, but i'm just trying to figure out how to get the frame work and just take it somewhere else so someone else can finish it. *sigh* I'm just gonna eat the cost...there's nothing I can really do about it right now....I'm basically SOL

Either that, go to small claims court for it.. that's a lot of money to just let go.

Threaten his ass with a lawyer.. Tell him that you have contacted a lawyer and what he is doing isnt right and that you will take him to court for eitherthe $1100. or the finished product.

F him get tough until you are satisfied.. That or get a big muscle bound tough guy to go with you and tell that dude is gonna break all his fingers and he'll never work again if he doesnt do right by you..

Thats what I would do..

I've been going to this audio place and he was a manager there and we became friends...well more with my bf. Trust me i've tried calling him...Showing up to his house...going to his job...I mean he's no where to be found. I know he's around because there are times when I call up to the Audio store for other things he'll pick up..but i guess i'm not lucky enough to catch him..... :(

Small claims court is cheap -- well worth the $1100 and time it will take to nail his ass.

Also file a report with the Texas BBB (Better Business Bureau) I guarrantee the owner of the shop (if its not him) gets on him real fast to resolve that issue..

Hmm thats not good... I would stilll attempt to contact the BBB and file a complaint against their business. Its a start I look into what else you can do..

Check or cash? If cash check to see if you have an ATM receipt or some sort of statement with the amount. Its not much, but its a start. If you can prove the car was at his house and get witnesses to the verbal agreement you might have a better chance.

Matt has an excellent point if you have witnesses that can say your car was there that might help.

Also I just thought of this I am not sure about the municipal laws in TX but here in NJ as well as parts of FL I know that in order to run a business out of your garage you need city permits, if you know he doesnt have any threaten to blow the whistle with the city and get him into trouble. If the city comes down on him he would be forced to close his shop and pay a huge amount of fines.

Make sure he has busy type products there. Work orders, people's cars, etc. It has to look like he has a business or its just an allegation.

I paid him cash...he just has A LOT ALOT of tools and other stuff he can always say he's working on his car. Which he does so that won't work. As for the people knowing my car was there it was his co-workers and I don't know how much they'll confess.....

Yeah friends of his aren't gonna be any good, unless they are better friends with you. But from the sounds of it thats not the case. You should get a different car (a rental or someone elses) sit outside his house and wait for him when he gets there, confront his ass about it , that or demand you get you box back. Do you know if he even started on it??

I finally got a hold of him....I had to call from like different peoples cell phone...Anyways..He said he'll let me come get the frame work. We'll see how that goes...If I get the frame work...then i'll be alright. I'll just take it as my subs, amp, strobes, and frame work was that much. At this point I just want my items and if I get that Im good to go, because then i can take it to a Audio Shop and get them to finish what I wanted.

Congrats on getting a hold of him..

Now lets keep our fingers crossed on him following through with that. Do yourself a fovor the next place you go to make sure to get a receipt no matter how you pay. By you having some form of paperwork will help a great deal if this ever happens again. Keep up on the info Im curious to see how this goes..

Thanks...I was so excited when he picked up his cell phone, but then again I was REALLY UPSET...so I tried to keep my cool just so I could get my things back. Yea I will definately go to a highly recommended place and be SURE this time to get paperwork...I will keep you posted and let you know how this goes. THANKS for all the advice and help...I relaly appreciate it... :up:

Yeah sorry also.. :oops: I would go to the local police station and ask what you can do, tell them the truth that he was building something for you and wont give it back. Maybe they could send an officer over there with you to talk to him about giving it back..

Its worth a shot. I would exhaust all options first beforer calling it a complete loss.

I would check into small claims court, especially if you are going to file a police report.
Small claims isn't like regular court -- it's your word against his -- and who is more believable to a judge. I'd say you. :wink:

Jaquetta has an awesome point rules are different in small claims court, if you file a police report and that turns into a dead end atleast you'll have paperwork to bring with you to court now.. :ponder:

I can understand your fear about him knowing where you live and coming to your house, however I wouldnt give up. If your persistent enough he will get sick of you and hopefully give you back whats yours..

I would go to the local police dept and tell them that this guy was building something for you and that you went there to get it and he wont answer. You called him and spoke to him on the phone and he said to come over and get it but he is never at home or refuses to answer his door and all you want is to get your belongings back. Check and see if they will send an officer over there with you to get it back...

Tell him your regular deal and when he says well I was busy or what not, confront why the work is still not done. Basically nail him down on all ends. Also bring up that you paid him 1100 in cash. get a reply out of him when you mention everything. This can be used to give to the cops, in small claims court, and as blackmail to get him to work.

One Quick lesson in life Never Give Cash up front. I have seen it a million times and will most likely see it a million More . Never give a person the money before service is rendered its one of the Biggest scams out there . good luck and hope you get you money back also have you reciepts or bank staments ready and take his ass to small claims ..

................................After i got back from Oklahoma I haven't called once....so it has been a week since my last phone call to him....HPD here are A$$HOLES....so i know when i go there...they are just gonna tell me I'm SOL...I got into an accident and they told me within 24 hours an officer will be there because no one is bleeding. Or you can go file one yourself and when I got there...they treated me like SH!T....so yea i don't like them at all...
